نظرة عامة
مرحباً بك في بابيلوكس! تشير كلمات «نحن» و«لنا» إلى بابيلوكس. تُدير بابيلوكس هذا المتجر والموقع، بما في ذلك كل ما يتصل به من معلومات ومحتوى وميزات وأدوات ومنتجات وخدمات لتقديم تجربة تسوّق مختارة بعناية لك، أنت العميل («الخدمات»). بابيلوكس مبنيّ على منصّة Shopify التي تُمكّننا من تقديم الخدمات لك. تصف هذه الشروط، مع أي سياسات مشار إليها فيها، حقوقك ومسؤولياتك عند استخدام الخدمات. يُرجى قراءتها بعناية لأنها تتضمّن معلومات مهمة عن حقوقك القانونية، وإخلاءات الضمان، وحدود المسؤولية. بزيارتك أو استخدامك لخدماتنا، فإنك توافق على الالتزام بهذه الشروط وسياسة الخصوصية. إذا لم توافق، يُرجى عدم استخدام الخدمات.
1 — الوصول والحساب
بموافقتك على هذه الشروط، فإنك تُقرّ بأنك بلغت سنّ الرشد في بلدك، وتتحمّل مسؤولية أي استخدام يقوم به من تعولهم من القُصّر على أجهزتك. قد يُطلب منك تقديم معلومات مثل بريدك الإلكتروني وبيانات الفوترة والدفع والشحن، وتتعهّد بأن كل ما تقدّمه صحيح ومحدّث وكامل. أنت وحدك المسؤول عن سرّية بيانات حسابك وعن كل نشاط يجري عليه، ولا يجوز نقله أو بيعه لأي شخص آخر.
2 — منتجاتنا
بذلنا كل جهد لعرض منتجاتنا بدقّة، لكن قد تختلف الألوان أو المظهر حسب جهازك وإعداداته. لا نضمن أن مظهر أو جودة المنتجات ستطابق توقّعاتك تماماً. تخضع أوصاف المنتجات للتغيير في أي وقت دون إشعار، ونحتفظ بحق إيقاف أي منتج أو تحديد كمياته لأي شخص أو منطقة.
3 — الطلبات
عند تقديم طلب فإنك تقدّم عرضاً للشراء، ولبابيلوكس الحق في قبوله أو رفضه لأي سبب. لا يُعتبر الطلب مقبولاً حتى نؤكّد قبوله، ويجب استلام دفعتك ومعالجتها أولاً. راجِع طلبك بعناية قبل إرساله لأننا قد لا نتمكّن من تلبية طلبات الإلغاء بعد القبول. تخضع مشترياتك للإرجاع أو الاستبدال وفق سياسة الاسترجاع لدينا فقط.
4 — الأسعار والفوترة
تخضع الأسعار والخصومات والعروض للتغيير دون إشعار. السعر المُطبَّق هو السعر الساري وقت تقديم الطلب كما يظهر في بريد تأكيد الطلب. ما لم يُذكر خلاف ذلك، لا تشمل الأسعار الضرائب أو الشحن أو الرسوم الجمركية. تتعهّد بتقديم معلومات دفع صحيحة وكاملة وتحديثها، وبأنك مخوّل باستخدام وسيلة الدفع، وبسداد كل الرسوم المستحقة بالأسعار المعلنة.
5 — الشحن والتوصيل
لسنا مسؤولين عن تأخّر الشحن أو التوصيل. جميع أوقات التسليم تقديرية وغير مضمونة، ولسنا مسؤولين عن التأخير الناتج عن شركات الشحن أو الجمارك أو ظروف خارجة عن إرادتنا. بمجرّد تسليم المنتجات لشركة الشحن تنتقل إليك ملكيتها ومسؤولية فقدانها.
6 — الملكية الفكرية
جميع العلامات التجارية والنصوص والصور والرسومات والتصاميم في خدماتنا مملوكة لبابيلوكس أو الجهات المرخِّصة لها ومحميّة بموجب القوانين. تسمح لك هذه الشروط باستخدام الخدمات لأغراضك الشخصية غير التجارية فقط، ولا يجوز نسخ أو توزيع أو تعديل أو إعادة نشر أي مادة دون إذن كتابي مسبق منّا. جميع الحقوق غير الممنوحة صراحةً محفوظة لبابيلوكس.
7 — الأدوات الاختيارية
قد نتيح لك أدوات من جهات خارجية «كما هي» دون أي ضمانات، واستخدامك لها على مسؤوليتك الخاصة، ويُرجى الاطّلاع على شروط مزوّديها.
8 — روابط الأطراف الثالثة
قد تحتوي الخدمات على روابط لمواقع تديرها أطراف ثالثة، ولسنا مسؤولين عن محتواها أو دقّتها. زيارتك لها على مسؤوليتك، ويُرجى مراجعة سياساتها.
9 — العلاقة مع Shopify
بابيلوكس مبنيّ على Shopify، لكن جميع عمليات البيع والشراء تتم مباشرةً مع بابيلوكس. تُقرّ بأن Shopify غير مسؤولة عن أي جانب من عمليات البيع بينك وبين بابيلوكس.
10 — سياسة الخصوصية
تخضع جميع المعلومات الشخصية التي نجمعها لسياسة الخصوصية لدينا. ولأن الخدمات مستضافة على Shopify، فقد تُجمع بعض معلوماتك وتُعالَج من قِبَل Shopify لتقديم الخدمة وتحسينها.
11 — الملاحظات والاقتراحات
أي ملاحظات أو اقتراحات تُرسلها تمنحنا ترخيصاً دائماً وعالمياً وغير حصري لاستخدامها لأي غرض دون التزام بالسرّية أو التعويض. وتتعهّد بأنك تملك الحقوق اللازمة لها وأنها لا تنتهك حقوق الغير.
12 — الأخطاء وعدم الدقّة
قد تحتوي الخدمات أحياناً على أخطاء مطبعية أو معلومات غير دقيقة تتعلّق بالأوصاف أو الأسعار أو التوفّر، ونحتفظ بحق تصحيحها وتحديث المعلومات أو إلغاء الطلبات دون إشعار مسبق.
13 — الاستخدامات المحظورة
يُسمح باستخدام الخدمات للأغراض المشروعة فقط. يُحظر استخدامها لأي غرض غير قانوني أو ضار، أو لانتهاك حقوق الملكية الفكرية، أو للتحرّش أو الإساءة، أو لبثّ معلومات مضلّلة أو رسائل مزعجة، أو انتحال شخصية الغير، أو رفع برمجيات ضارّة، أو جمع بيانات الآخرين. نحتفظ بحق إيقاف أو تعطيل حسابك عند مخالفة أي جزء من الشروط.
14 — التغييرات على الشروط
يمكنك مراجعة أحدث نسخة من الشروط في أي وقت على هذه الصفحة، ونحتفظ بحق تحديثها أو تغييرها بنشر التعديلات هنا. استمرارك في استخدام الخدمات بعد نشر أي تغييرات يُعدّ قبولاً لها.

Welcome to Babilux! The terms "we", "us" and "our" refer to Babilux. Babilux operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Babilux is powered by Shopify, which enables us to provide the Services to you. These Terms of Service, together with any policies referenced herein, describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights, warranty disclaimers and limitations of liability. By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not use the Services.
1 — Access and Account
By agreeing to these Terms, you represent that you are at least the age of majority in your place of residence, and you consent to any minor dependents using the Services on devices you own or manage. You may be asked to provide information such as your email, billing, payment and shipping details, and you warrant that all information provided is correct, current and complete. We have made every effort to represent our products accurately, but colors and appearance may differ depending on your device and its settings. We do not warrant that the appearance or quality of products will meet your expectations. Product descriptions may change at any time without notice, and we reserve the right to discontinue any product or limit quantities to any person or region.
3 — Orders
When you place an order you make an offer to purchase, and Babilux may accept or decline it for any reason. Your order is not accepted until Babilux confirms acceptance, and we must receive and process payment first. Review your order carefully before submitting, as we may be unable to accommodate cancellations after acceptance. Purchases are subject to return or exchange solely in accordance with our Refund Policy.
4 — Prices and Billing
Prices, discounts and promotions are subject to change without notice. The price charged is the price in effect when the order is placed, as shown in your order confirmation email. Unless stated otherwise, posted prices do not include taxes, shipping or customs charges. You agree to provide accurate, complete payment information and keep it updated, that you are authorized to use the payment method, and that you will pay all charges at the posted prices.
5 — Shipping and Delivery
We are not liable for shipping or delivery delays. All delivery times are estimates only and not guaranteed. We are not responsible for delays caused by carriers, customs, or events outside our control. Once products are transferred to the carrier, title and risk of loss pass to you.
6 — Intellectual Property
Our Services, including all trademarks, text, images, graphics and designs, are owned by Babilux or its licensors and protected by law. These Terms permit personal, non-commercial use only. You must not reproduce, distribute, modify, republish, or transmit any material without our prior written consent. All rights not expressly granted are reserved by Babilux.
7 — Optional Tools
We may provide access to third-party tools "as is" without warranties. Your use of them is at your own risk, and you should review the relevant third-party terms.
8 — Third-Party Links
The Services may contain links to third-party websites whose content and accuracy we do not control. You access them at your own risk and should review their policies.
9 — Relationship with Shopify
Babilux is powered by Shopify, but all sales and purchases are made directly with Babilux. You acknowledge that Shopify is not responsible for any aspect of sales between you and Babilux.
10 — Privacy Policy
All personal information we collect is subject to our Privacy Policy. Because the Services are hosted by Shopify, some of your information may be collected and processed by Shopify to provide and improve the Services.
11 — Feedback
Any feedback or suggestions you submit grant us a perpetual, worldwide, royalty-free license to use them for any purpose, with no obligation of confidentiality or compensation. You warrant that you own the necessary rights and that your feedback does not violate any third-party rights.
12 — Errors, Inaccuracies and Omissions
The Services may occasionally contain typographical errors or inaccuracies regarding descriptions, pricing or availability. We reserve the right to correct them and to update information or cancel orders without prior notice.
13 — Prohibited Uses
You may use the Services for lawful purposes only.
